This is the user agreement for QueerMatch.com. It was last updated on January 7, 2005. Please read the terms of service before using this site. You are responsible for reviewing and understanding these terms. Your use of QueerMatch.com and services following this notification constitutes acceptance of these terms of service.

Our Privacy Policy covers the security of the information you send to us.

By using and/or registering to become a member of QueerMatch.com, you are stating that you understand and agree to be bound by the terms and conditions of this QueerMatch.com user agreement. Read the agreement carefully. If you don’t agree with any of the terms and conditions, please do not use QueerMatch.com or any of the services provided. You must agree to all the terms and conditions in order to be an authorized user QueerMatch.com.

Use of QueerMatch.com is subject to any limitations, conditions, and restrictions that we institute from time to time, using our exclusive discretion. We may change, defer, or terminate any area of QueerMatch.com at any time, including the accessibility of any QueerMatch.com feature, database, or content. We also reserve the right to restrict your access to any or all parts of QueerMatch.com without notice or legal responsibility.

You stand for, merit, and covenant that you are at least 18 years old.

You concur and accept that you will obey the following guidelines when using QueerMatch.com. You agree to not use QueerMatch.com to:

• Limit or restrain any other user from using and benefiting from the Internet; you will not use QueerMatch.com to post or transmit any illegal, threatening, abusive, defamatory, slanderous, racist, ageist or vilifying information, advertisements, pictures, or communications that have offensive words or images of any kind, including without restriction any transmissions constituting or encouraging behavior that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial, state, national, or international law.
• Post or transmit any information or software which contains a virus, cancelbot, Trojan horse, worm, or any other damaging factor.
• Dispense, endorse or otherwise publish any material containing any solicitation of funds, advertising, or solicitation for goods or services, except within circumstances that we deem, at our sole discretion, appropriate.
• Post advertisements or other information that we deem to be disingenuous or non-serious use of QueerMatch.com.
• Promote unlawful activity.
• Post information, advertisements, communications or images for the goal of meddling or trapping by law enforcement or security agencies, media, or any other person or agency.
• Post advertisements, information, images, or communications or use QueerMatch.com to defy in any manner, plagiarize, or infringe upon the rights of any third party, encompassing but not limited to any copyright or trademark law, privacy, or other personal or proprietary rights.
• Post or communicate pictures or images on QueerMatch.com of anyone under 18 years of age or depict any person on QueerMatch.com as being younger than 18 years of age. We report these occurrences directly to the FBI.
• Post any information, advertisements, images or communications that break any criminal or other laws regarding obscenity, pornography, child pornography or otherwise.

  We at QueerMatch.com reserve the right, without limitation, to:

• Monitor all information, advertisements, images, and communications for suitability and tolerability.
• Move, delete or otherwise handle any information, advertisements, images or communications that we agree break any part of the Terms of Agreement or are otherwise objectionable.

  Privacy and the use by QueerMatch.com of your information are covered in the Privacy Policy. Please refer to that document for information.

  You represent that you are the only owner of all rights in anything you post (including all related copyrights) or that you have the complete right to authorize their use as provided in this section. Although you have ownership of the copyright in the materials you post, you agree that all materials that you post become part of a database, and that QueerMatch.com owns the compilation copyright of the database.

  You allow QueerMatch.com everlasting, universal, and permanent license to use, reproduce, modify, publish, publicly perform, publicly display and distribute such materials, any factor of such materials, or anything that derives from such materials, in print, electronic, and other media, and by means now known or created in the future.

  QueerMatch.com has the right to sublicense all of our rights and licenses or assign them to third parties. You will not be paid any royalties or receive any compensation for the use of the materials that QueerMatch.com or any third party may use in accordance with this section.

  Disclaimer: You realize and accept that use of QueerMatch.com is at your own risk. We are not responsible for any ancillary, resulting, special, punitive, exemplary, direct or indirect damages of any kind whatsoever that may arise out of or relating to the use or inability to use QueerMatch.com. Any personal meetings or encounters you may have that are a result of or are related to the use of QueerMatch.com are also at your own risk.

  For any breach by you of this Agreement or any changes or complaints made by other parties against you, you agree to compensate us, our offices, directors, employees, and agents for any loss or damages including but not limited to logical legal fees which QueerMatch.com may have incurred. You will assist us as much as sensibly required in the defense of any claim. If you stay accountable for claims, QueerMatch.com has the right to assume the exclusive defense and control of any matter otherwise subject to damages by you.

  QueerMatch.com may change or otherwise modify this Agreement. At our sole discretion, there will be notification of any amendments via posting on the site or electronic mail. You must cease your use of QueerMatch.com if you do not agree with any of the modifications to the Agreement. A binding acceptance by you of this Agreement will be constructed if you continue to use the site now or following the notification or posting or any changes made to this Agreement.

  QueerMatch.com is solely for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from QueerMatch.com.

  In accordance with the laws of the Commonwealth of Massachusetts, this Agreement will be construed and enforced. Every section of this Agreement will apply to the full extent permitted by law. Any defect in whole or in part of any section or provision will not affect the remaining provisions or any other provisions.
